PORTALJABAR, BANDUNG CITY - Acting Governor of West Java Bey Machmudin attended the West Java Provincial DPRD Plenary Meeting at the West Java DPRD building, Bandung City, Tuesday (23/4/2024).

At this plenary meeting, there were two meeting agendas. First, namely regarding Changes in the Membership of the Council Equipment from the Democratic Party Fraction.

The agenda for the first meeting was carried out based on a letter from the Democratic Party Fraction to the Chairman of the West Java DPRD assigning Andi Zabidi to become a member of the Regional Regulation Formation Body (Perda) of the West Java DPRD replacing Dede Chandra Sasmita.

"These changes were determined at this plenary meeting," said Chairman of the West Java DPRD, Taufik Hidayat.

Meanwhile, the agenda for the second meeting was the Submission of the West Java Governor's Opinion on the Three Draft Regional Regulations of the West Java DPRD Initiative.

Bey Machmudin said that at the West Java DPRD Plenary Meeting which was held on April 19 2024, the West Java DPRD Regional Regulation Formation Body had submitted the Draft Regional Regulation for Initiative.

First, namely the Regional Regulation on the Implementation of Consumer Protection.

Second, Draft Regional Regulation concerning the Implementation of Respect, Protection and Fulfillment of the Rights of Persons with Disabilities.

Third, Draft Regional Regulation concerning Governance of Research, Development and Application of Science and Technology in West Java.

"The three draft regional regulations referred to are none other than the protection of society and the progress of regional development in West Java Province," said Bey Machmudin.

Regarding the Draft Regional Regulation on the Implementation of Consumer Protection, Bey said that the basic conception in drafting this Draft Regional Regulation should in essence not conflict with the provisions of higher laws and regulations.

According to Bey, implementation requires strengthening the role of the provincial government, which of course must be in accordance with the provincial authority.

Therefore, the formulation of the Ranperda concerning the Implementation of Consumer Protection is directed at providing protection for consumer rights as well as regulating the rights and obligations of goods business actors and service providers as stated in Law Number 8 of 1999 concerning Consumer Protection.

So that there is urgency and encouragement to form a Provincial Representative of the National Consumer Protection Agency (PBPKN), Bey is of the view that it must be in line with the duties of the National Consumer Protection Agency as regulated in Law No. 8 of 1999.

"However, on the other hand, it will intersect with the main duties and functions of the West Java Provincial Industry and Trade Service in the field of Consumer Protection as well as the main duties and functions of the BPSK (Consumer Dispute Resolution Agency)," said Bey.

In this way, the imposition of sanctions in the draft regional regulations must not conflict with the sanctions that have been regulated in Law No. 8 of 1999 and the regional regulations can only regulate sanctions for violations that have not been regulated in law.

Regarding the Draft Regional Regulation on Implementing Respect, Protection and Fulfillment of the Rights of Persons with Disabilities, Bey said that the specifics of fulfilling the human rights of persons with disabilities is a major concern to ensure that they carry out their lives without discrimination.

"So the state is obliged to be present to ensure that the rights of people with disabilities are fulfilled very well," he said.

As time goes by, continued Bey, Regional Regulation No. 7 of 2013 needs to be replaced to be harmonized with the provisions of higher laws and regulations and to be able to respond to various problems in the lives of people with disabilities in West Java.

In terms of fulfilling the rights of persons with disabilities, some of these have been embodied in several other regional regulations, such as regional regulations regarding the implementation of education, health, implementation of child protection, transportation, tourism and employment.

So for this draft regional regulation, Bey emphasized the need for the role and responsibility of regional governments to provide homes/homes as temporary shelters and provide various facilities for people with disabilities until they are able to be independent.

"Imposing sanctions for families of people with disabilities who neglect their family members who have disabilities needs to be considered," said Bey.

"Also the role of the community in respecting, protecting and fulfilling the rights of people with disabilities," he continued.

Finally, regarding the Draft Regional Regulation on the Governance of Research, Development and Application of Science and Technology in West Java, the Acting Governor of West Java proposed that it be realigned into the Implementation of a Science and Technology System.

"Our basic argument for requesting realignment of the title of the draft regional regulations to Implementation of Science and Technology Systems lies in the fact that the existence of science and technology cannot be limited by locus or region, but the direction and implementation of policies can be limited by regional authority," he said.

So, in accordance with the mandate of Law No. 11 of 2019, it is mandatory for regional governments to develop inventions and innovations so that the main substance in the draft regional regulations can be developed and aligned in terms of regional governments to work together in facilitating the development of technological incubation, industrial partnerships and the development of science and technology areas in accordance with readiness and excellence. area.

"Therefore, the direction of the draft regional regulation should be the harmonization of provincial policies and strategies in efforts to develop science and technology in accordance with local wisdom, including fostering the utilization of science and technology," said Bey Machmudin.
